Agreement to Terms

By accessing and using the email marketing services provided by charxrelvlozarin, you agree to be bound by these Terms of Use and all applicable Australian laws and regulations, including the Australian Consumer Law (ACL) and the Spam Act 2003 (Cth).

These terms are governed by the laws of Victoria, Australia, and any disputes will be subject to the exclusive jurisdiction of the courts of Victoria.

Service Description

charxrelvlozarin provides email marketing and newsletter services, including campaign management, template design, automation, analytics, and related services. Services are provided from our Melbourne office.

We make reasonable efforts to ensure our services are available, but we do not guarantee uninterrupted or error-free service.

Australian Consumer Law

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.

You also have rights under the Australian Consumer Law if the services we supply are not of acceptable quality, not fit for purpose, or do not match their description.

User Responsibilities

You agree to:

• Provide accurate and complete information when using our services
• Comply with all applicable Australian laws and regulations, including the Spam Act 2003 (Cth) and Privacy Act 1988 (Cth)
• Obtain proper consent from email recipients before sending marketing communications
• Maintain the security of your account credentials
• Use our services only for lawful purposes
• Ensure all emails sent through our platform comply with the Spam Act 2003 (Cth)

Prohibited Activities

You may not:

• Send unsolicited commercial electronic messages in violation of the Spam Act 2003 (Cth)
• Violate privacy rights or breach the Privacy Act 1988 (Cth)
• Infringe on intellectual property rights
• Transmit viruses, malware, or harmful code
• Use our services to engage in fraudulent, deceptive, or misleading conduct
• Use our services to harass, threaten, or harm others

Payment Terms

Service fees are billed according to your selected subscription plan in Australian Dollars (AUD). Payments are due in advance for each billing period. Failure to pay may result in service suspension or termination.

All prices include GST where applicable. We will provide a tax invoice for all payments.

Intellectual Property

All content, features, and functionality of our services are owned by charxrelvlozarin and are protected by Australian copyright, trademark, and other intellectual property laws.

You retain ownership of content you create using our services, but grant us a licence to use it for the purpose of providing our services.

Limitation of Liability

To the maximum extent permitted by Australian law, charxrelvlozarin liability is limited as follows:

• We exclude liability for indirect, incidental, special, or consequential damages
• Our total liability is limited to the amount you paid for our services in the 12 months preceding the claim
• Nothing in these terms excludes, restricts, or modifies your rights under the Australian Consumer Law

Dispute Resolution

If you have a complaint or dispute, please contact us first. We will attempt to resolve the matter within 30 days. If we cannot resolve the dispute, you may refer it to the Australian Competition and Consumer Commission (ACCC) or seek legal advice.

Changes to Terms

We may update these Terms of Use from time to time. We will notify you of significant changes by email or through our website. Continued use of our services after changes constitutes acceptance of the new terms.
